Introduction

As further explained below, we endeavor to recognize current standards of privacy including, but not limited to, the following requests you can make of us:

Request to Know

You may request that we provide to you information regarding Personal Information (defined below) that we have collected, used, or shared about you, and why we did so.

Request Deletion

You may request that we delete your Personal Information from our systems and tell our service providers to do the same.

Opting Out

At the time you subscribe to or tell us your preferences for receipt of newsletters, e-mails or other communication to receive from us or if at any point we share data, you may request that we stop sharing your Personal Information (“opt-out”). Complying with your request may impact our ability, technically, to provide access to our Service.

The Impact of Making Requests under this Privacy Policy

We will not deny Service, charge you a different price, or provide a different level or quality of Service just because you exercised your options pursuant to this Privacy Policy. However, we may need certain information in order to provide you with certain Service and prohibiting the use of certain information may make it technically impossible to provide some Service.

Correcting Inaccurate Information

You may ask us to correct or delete inaccurate information that we may have about you.

Limiting the Use of Sensitive Information

You may direct us to only use particularly sensitive Personal Information (i.e., financial account information) for limited purposes, such as making a donation, registering for an event or providing you with the Services you may have requested.

Details and clarification of the above may be found throughout the remainder of this Privacy Policy. We ask that you read it completely.

If after reading this Privacy Policy, you wish to take any actions listed above, or if you believe that we are not acting consistently with any of the standards above please contact KVIE’s Associate General Manager – Operations Staci Orlando-Waters at sorlando@kvie.org.

What We Mean by Personal Information

For purposes of this Policy “personal information” includes your name, address, telephone number, email address, credit card or other financial information associated with payment for a product, service or donation and personal and subscription preferences you may designate when creating an account profile (“Personal Information” or “PI”). Personal Information does not include “aggregate” or tracking information, which we collect automatically about the use of our Service. Aggregate or tracking information does not identify you personally and means collective data that relates to a group or category of visitors or users, from which individual identities or characteristics have been removed. This Policy does not restrict or limit our collection, use and/or sharing of aggregate information.

Personal Information We Collect

This Privacy Policy applies to your personal information whether you give it to us by phone, mail, email, in person, over the internet via any device (now known or hereafter created) or other means. We collect certain information you voluntarily provide to us including, without limitation, the information you enter if you create an account or profile, send us an email, make a donation, subscribe to one or more KVIE newsletters, enter into a subscription agreement or end user license agreement with us for a service we offer, request user support, view content or submit or post content to the Service, including but not limited to our social media platform.

We may automatically collect certain information when you visit or use the Service including, without limitation, your Internet Protocol ("IP") address, your operating system, the browser type, the address of a referring site and your activity on or in use of the Service. We may also collect information from mobile phone users in a similar manner to optimize the mobile experience. Beyond mobile phone numbers, we may collect mobile screen resolution, device make and manufacturer and may also collect the device’s unique identifier (in the iPhone’s case, a UDID), and your location. We treat this information as Personal Information if we combine it with or link it to any of the identifying information mentioned above. Otherwise, it is used in the aggregate only.

We may also receive collected personal information from third parties and may combine this information with personal information we maintain about you. If we do so, this Privacy Policy will govern our use of the combined information.

The Service may allow you to send messages to other Service users in the future. These messages may be stored for retrieval at later times in order to facilitate communication.

The Service may allow you to make financial transactions in connection with the Service. Payment processing companies we engage are required to meet data security levels that are standard in the payment card industry when a transaction is made, including the date and type of purchase made, your credit card number, expiration date, billing address, and CVV or security code number.

Even after you remove information from your profile or delete your account or cease use of our Service, or ask us to delete your information, copies of that information may remain elsewhere to the extent it has been shared with others, it was otherwise distributed pursuant to your privacy settings, or it was copied or stored by others. If you post any of your information to a public area of the Service, please be aware that it is no longer “personal information” for purposes of this Policy, and we or anyone else may use such information without restriction. If you provide access to personal or other information, including your email address or name, to others through the application of any of our privacy controls or other Service settings, you hereby acknowledge and agree that we have no control over or liability for how others may collect, use, or disclose such information.

In some circumstances, opting out may prevent you from participating in activities for which personal information is needed, such as contests and/or certain services. If you want to remain completely anonymous you may still be able to take advantage of select content which is available (where it is specified to be accessible without registration) via our Service.

Like many other nonprofits, KVIE occasionally exchanges some of our donors’ names and postal addresses with select educational, cultural, health, and social service organizations in order to reach more potential supporters of our organization in a cost-effective manner. We allow those organizations to mail KVIE donors only once, after which they must destroy our donors’ information. KVIE does not exchange email addresses or phone numbers. KVIE may also disclose some personal information to screened third-party service providers such as mailing houses and fundraising organizations. We may contract with them for the limited purpose of assisting us with marketing and promotional activities. We require them to adhere to this Privacy Policy.

Consent to Collect Personal Information

You understand the purposes for which your personal information may be collected, and you voluntarily consent to its collection, use or disclosure by us. You may withdraw your consent or request a correction of your personal information at any time by providing us with forty-five (45) days’ notice. Send this notice to our Director of Development at Member@kvie.org. The Director of Development is our contact person for purposes of addressing questions or comments about this Privacy Policy.

Please note that we may be required to keep your personal information and not delete it (or to keep this information for a certain time, in which case we will comply with a deletion request you may submit to us only after we have fulfilled such requirements). When we delete any information, it will be deleted from the active database but may remain in our archives.

Information Retention and Disposal

We may retain personal information for as long as we have a business need for it or as applicable laws, regulations, or government orders require us to retain it. Additionally, the Service may enable you (or other users) to save information including information that you have made public or allowed certain users to access or see.

Use of Financial Information

You may use a credit card, EFT/ACH information, or check when making a donation to KVIE, when making a purchase or when downloading an application. If you make a donation, purchase products, pay for services or download an application via the Service or Service vendor, the transaction may be handled by our service vendor or the application platform responsible for processing your payment. This vendor may have its own privacy policy and if so, those terms will apply to you. Please be sure to review them at the links provided when submitting information for payment processing. If you do not agree with a vendor’s privacy and terms of use, do not proceed. Contact the Director of Development at: Member@kvie.org.

We may require your payment or credit card information in order for our payment vendor or us to process purchases. This includes your name, payment or credit card number, expiration date, billing address, and authentication codes or related information as needed to authorize the charge and complete the transaction. Credit card data is transferred via technology currently known as a “Secured Sockets Layer”(“SSL”) if you are using an SSL enabled browser such as Microsoft Internet Explorer, Microsoft Edge, Firefox, Safari, or Google Chrome.

Information from financial transactions made through a KVIE Service is stored and served via a SSL server. Each page you view and any financial information you submit is encrypted during transmission between our Service and payment processors.

We take reasonable measures to protect your personal information in an effort to prevent loss, misuse, and unauthorized access, disclosure, alteration, and destruction. Our Service hosting providers apply security updates routinely and monitor to address known security issues, consistent with industry standards.

Please be aware, however, that despite our efforts, no security measures are perfect or impenetrable and no method of data transmission can be guaranteed against any interception or other type of misuse. To mitigate this risk, you should:

  • use secure usernames and passwords and carefully protect them from disclosure; and
  • implement updated internet security and virus protection on your computer. If you suspect that your computer’s security or your information has been compromised or your password accessed or used by an unauthorized third party, please immediately change your password.

If we become aware of a security systems breach, we may attempt to notify you electronically so that you can take appropriate protective steps. We may post a notice through the Service if a security breach occurs. We may also send an email to you at the email address you have provided to us to use in these circumstances.

KVIE has no control over other sites that are linked to ours and we cannot tell you how those sites will treat your personal information. For all online financial transactions you make through organizations that link to our Service, be sure to review those organizations’ privacy policies. If you have any questions regarding how the organizations use your personal information, please contact them directly.

We have no access to, responsibility for, or control over other parties’ personal information collection practices, even those with which we may have an affiliation.
